The decision relates to an ongoing investigation into Braun's actions during a Hanukkah ceremony in December 2023, when he extinguished Hanukkah candles in the Polish parliament using a fire extinguisher.

The investigation is being led by the District Prosecutor's Office in Warsaw. Earlier, the Polish parliament had already lifted Braun's immunity in connection with the incident.

As Braun was elected to the European Parliament in June 2024, Polish prosecutors sought to have his immunity removed at the EU level to allow for legal proceedings to move forward.
