Poland's Kaczyński loses parliamentary immunity over assault accusation

The Polish Sejm, the lower house of parliament, has voted to revoke the immunity of opposition leader Jarosław Kaczyński over an accusation of assault against a citizen.

Polish MPs voted on Friday to strip Kaczyński of his parliamentary immunity in connection with accusations of assaulting activist Zbigniew Komosa during a memorial event for the victims of the 2010 Polish presidential air crash in western Russia, state news agency PAP reported.

Kaczyński, who leads the conservative Law and Justice Party (PiS), said that he expected the decision and defended his actions against Komosa, describing them as a self-defense reaction prompted by a "sense of total impunity" from the activist.

A total of 241 lawmakers voted in favor of lifting Kaczyński's immunity, while 206 opposed.

Meanwhile, the Sejm did not agree to lift Kaczyński's immunity in a separate case involving the destruction of a wreath during the same memorial event.

The house also rejected a motion for lifting the parliamentary immunity of two other members of Kaczyński's nationalist-populist party, Anita Czerwińska and Marek Suski, who were accused of damaging the wreath and stealing a plaque, the PAP news agency reported.

Kaczyński reiterated his claim that the Polish air disaster near the western Russian city of Smolensk, which killed his twin brother Lech, then Poland's president, and 95 others on April 10, 2010, was orchestrated by Moscow, with the "possibility of certain Polish groups" being involved.

Prime Minister Donald Tusk welcomed the house's decision shortly after it was announced. "The key takeaway is that we secured a sufficient majority in this crucial vote on the immunity of Jarosław Kaczyński for an act against a citizen," he said.
