Top EU court imposes fine on Poland for breach of European telecoms code

The Court of Justice of the European Union has levied a fine against Poland for not incorporating the European Electronic Communications Code into its national legislation, a framework critical for governing the telecommunications market within the bloc.

Poland faces a daily penalty of EUR 50,000, along with a one-time lump sum of EUR 4 million, due to its failure to meet the implementation deadline set for December 21, 2020.

The top EU court found Poland's justifications for the delay, including claims of regulatory imprecision and the impacts of the COVID-19 pandemic, to be insufficient.

The Polish Ministry of Digitization attributed the delay to oversights by the previous administration and emphasized ongoing efforts to achieve full compliance with the European Electronic Communications Code, Polish state news agency PAP reported.

"We remain in dialogue with the European Commission, striving for smooth and full implementation of the provisions," said Deputy Digitization Minister Michał Gramatyka. "This is one of our priorities."

According to reports, the government aims to complete the legislative process by May, with the intention of submitting the drafts to the Sejm, the lower house of the Polish parliament, by June at the latest.
